The following terms and conditions ("Terms") govern your access to and use of the Eli Health website and services ("Services"). By accessing or using our Services, you agree to these Terms. If you do not agree, please do not use our Services.

Definitions

The Hormometer™ is Eli Health’s integrated hormone‑tracking platform, combining:

A disposable saliva test
A single‑use lateral‑flow immunoassay cartridge that collects and reacts with your saliva sample. -
A smartphone app
A mobile application that uses your phone’s camera to scan the test strip, applies image‑analysis algorithms to derive a semi‑quantitative hormone reading, displays easy‑to‑read trend graphs over time and delivers insights.

"User," "you," or "your" refers to any individual accessing or using the Services.

"We," "us," "our," or "Eli Health" refers to Eli Health Inc.

"Products" means Hormometer™.

"Subscriptions" means any recurring or prepaid plan for delivery of Products.

Eligibility

You must be at least 18 years old to create an account or purchase Products.

If you are 13–17 years old, you may only use the Services with the consent and supervision of a parent or legal guardian. We comply with COPPA and applicable youth privacy laws, including Québec’s Law 25.

Privacy

Our Privacy Policy describes how we collect, use, share, and protect your personal information.

By using the Services, you consent to our data practices as outlined in the Privacy Policy.

Product Use

Eli Health Products provide insights into hormone levels via saliva samples. They are intended for informational use only.

Progesterone test kit – This is an over-the-counter in vitro diagnostic medical device (IVD) listed with the U.S. Food and Drug Administration under product code QKE. It is intended as an aid for the confirmation of ovulation and it should not be used as the sole basis for medical decisions. See the Instructions for Use for the intended use, contraindications, and limitations.
- Cortisol test kit – This product is marketed for general wellness purposes only under the FDA’s General Wellness enforcement policy. It is not a medical device, diagnostic tool, or intended for use in the diagnosis, cure, mitigation, treatment, or prevention of any disease.
- Neither product provides medical advice. Always consult a qualified healthcare professional for any medical concerns or decisions.

Orders, Shipping & Fulfillment

We ship to the United States and Canada.

Delivery times vary by carrier and location; estimated delivery dates are provided at checkout.

Returns & Refunds

Under the Quebec Consumer Protection Act, you may cancel your Subscription at any time by sending notice via email or through your account.

We will retain only the portion of fees corresponding to services already provided (tests shipped or used) and refund the remainder on a pro‑rata basis.

Refunds will be issued within 15 days of cancellation.

No additional cancellation penalties will apply.

Physical Products may be returned within 14 days of delivery if unopened and in original condition; opened or used tests are non‑returnable.

Refunds are processed within 15 days of receipt and inspection, issued to the original payment method, less shipping costs.

Prepaid Subscriptions: Refunds available only if no shipment has yet been fulfilled, except where prohibited by law.

Plans: 4, 8, or 12 tests per month (delivered as pack of 4 tests).

Billing: Recurs monthly on the subscription start date.

Renewal: Automatic unless canceled ≥48 hours before renewal.

Management: Pause or cancel anytime via your account portal.

One-time charge covering six months.

Shipments: Every 3 months (two shipments total).

4 Tests/Month: 3 packs total (12 tests per shipment)

8 Tests/Month: 6 packs total (24 tests per shipment)

12 Tests/Month: 9 packs total (36 tests per shipment)

Renewal: Automatic every six months unless canceled prior to renewal.

One-time charge covering twelve months.

Shipments: Every 3 months (four shipments total).

4 Tests/Month: 3 packs total (12 tests per shipment)

8 Tests/Month: 6 packs total (24 tests per shipment)

12 Tests/Month: 9 packs total (36 tests per shipment)

Renewal: Automatic every twelve months unless canceled prior to renewal.

Payment Authorization
By providing payment information, you authorize Eli Health to charge the full amount for any Products or Subscriptions you order.
All fees are non‑refundable, except as explicitly stated in these Terms or required by law.

Intellectual Property

All content, trademarks, logos, and data on the Services are owned by Eli Health or our licensors.

You may not reproduce, distribute, modify, or create derivative works without our express written permission.

Health Disclaimer & No Medical Advice

Information provided by Eli Health is for general informational purposes only.

Never disregard professional medical advice or delay seeking it because of something you have read on our site or in test reports.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELI HEALTH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF OUR SERVICES.

OUR TOTAL LIABILITY FOR DIRECT DAMAGES WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE APPLICABLE PRODUCT OR SERVICE.

Termination

We may suspend or terminate your access for violations of these Terms or applicable law.

You may terminate your account at any time by deleting your account through the portal or contacting support. Termination does not affect obligations incurred prior to termination.

Changes to These Terms

We may update these Terms from time to time; changes will be effective upon posting.

We will notify you of significant changes via email or in‑app notice. Continued use constitutes acceptance of the revised Terms.

Governing Law & Dispute Resolution

For Canadian users, these Terms are governed by the laws of Quebec; for U.S. users, by the laws of their state of residence, without regard to conflict of laws principles.

Disputes will first be attempted to be resolved through good‑faith negotiations. If unresolved, disputes shall be submitted to binding arbitration (Canadian Arbitration Association for Canada; AAA for U.S.), except that small‑claims court and statutory consumer rights remain available.
